Welcome to PokemartUSA, INC. These Terms of Service and Refund Policy (the “Terms”) govern your membership and transactions within our wholesale program. By engaging in any of the following activities, including but not limited to, program enrollment, membership subscription payment, order placement, and use of our site and private Discord server, you signify your full acceptance of these “Terms”.

  1. Membership
    1. Membership Fee
      1. The membership fee is required to maintain access to the program, including private channels and order placement privileges.
      2. Membership fees are non-refundable under any circumstances.
    2. Membership Benefits
      1. Membership grants access to the wholesale program and community.
      2. While we strive to fulfill all order requests, allocations depend on distributor availability and are not guaranteed.
      3. Your membership fee does not entitle you to specific products, quantities, or rates from our distributors.
    3. Membership Cancellation
      1. Members may cancel their membership at any time; however:
      2. Cancellation results in the immediate loss of tiered pricing and other membership benefits.
      3. Upon cancellation, you cannot re-enroll under your original pricing. Re-enrollment will be at the current list price available on our website.
      4. You are obligated to pay the membership fee for the entire term, regardless of usage.

  2. Orders
    1. Payment Methods
      1. A surcharge is applied as a separate transaction to cover processing fees.
      2. ACH Payments: less than 1% (capped at $5.00).
      3. Debit/Credit: 3% (uncapped).
      4. You authorize PokemartUSA, INC, and, if applicable, its affiliated entities to debit any payment method supplied for any amount owed for charges arising from your use of its services and/or purchase of products.
      5. PokemartUSA, INC will attempt to assess any surcharges against the payment method used on the invoice, however, if you opt not to store those payment details for later use, we may default back to any other method we have on file.
    2. Cancellation Policy
      1. Orders may only be canceled before an invoice is issued.
      2. Once an invoice has been dispatched, the order is final, and you are obligated to remit payment immediately.

  3. Direct2Customer (Drop-shipping) Orders
    Our Direct2Customer option allows you to ship products directly to your customers. By selecting this option, you agree to the following terms:
    1. Responsibility for Accuracy
      1. You are solely responsible for providing accurate and complete shipping information.
      2. We are not liable for errors in the shipping address provided by you.
    2. Assumption of Liability
      1. By choosing Direct2Customer, you accept full liability for the destination and delivery of the product.
      2. We will provide tracking information for your order. However, once the product leaves our possession, we are not responsible for issues related to delivery to the provided shipping address.
    3. Dispute Waiver
      1. You assume full responsibility for resolving disputes with your customers.
      2. We are not liable for chargebacks or disputes that arise from Direct2Customer orders.

  4. Failure to Pay
    1. Failure to remit payment may result in immediate termination of your membership.
    2. Membership fees remain non-refundable in such cases.

  5. Refund Policy
    1. No Refunds
      1. All sales, including membership fees and product orders, are final and non-refundable.
      2. This policy applies regardless of product allocation, delivery, or membership cancellation.
      3. PokemartUSA, INC reserves the right to make exceptions at its sole discretion.

  6. Shipping Policy
    1. Orders are generally shipped in 1 day after your order is processed, and they normally take an additional 3 – 5 business days to arrive.
    2. Orders are processed Mon-Fri during normal business hours.
    3. A separate invoice will be issued for associated order shipping fee’s once we have generated a label and have provided tracking information.

  7. Return Policy
    1. You may return damaged or defective merchandise within 10 days of the original purchase date for a full refund minus shipping charges. We will also be glad to exchange the damaged merchandise for anything on our site of equal or lesser value.

  8. Membership Termination
    PokemartUSA, INC reserves the right to terminate your membership without notice for violations of these Terms, including but not limited to:
    1. Non-payment of invoices.
    2. Chargebacks or disputes initiated against valid charges.
    3. In such cases, you forfeit all membership privileges and any fees paid.

  9. Amendments
    1. PokemartUSA, INC reserves the right to update these Terms at any time. Updates will be posted on our website, and continued membership or order placement constitutes acceptance of the revised Terms.
